Terms of Service
Effective: October 9, 2026 (2026-10-09)Last updated: October 9, 2026 (2026-10-09)
These Terms of Service ("Terms") are a contract between you and AR Dynamics Inc, a Hawaii corporation ("AR Dynamics," "we," "us," "our"), governing your use of CybrGate: the CybrGate browser extension, the CybrGate server and admin console, and this website (together, the "Service"). By installing the extension, creating an organization, subscribing, or otherwise using the Service, you agree to these Terms.
The short version
- The local scan is free and needs no account. Continuous monitoring is $8 to $12 per seat per month (Team $8, Business $12), bought self-serve through Stripe. No sales call.
- A paid subscription renews every month until you cancel. You cancel online, and it is as easy as signing up (Sections 5 and 6).
- You are responsible for deploying CybrGate to your employees lawfully, including any notice the law of your location requires (Section 8).
- CybrGate uses a local AI classifier as a second-stage filter, and its output can be wrong (Section 11).
- Our total liability is capped at one month of fees. Disputes go to individual arbitration, with a 30-day opt-out, under Hawaii law (Sections 16 to 21).
1 Parties & acceptance #
These Terms are entered into between you and AR Dynamics Inc. If you accept them on behalf of a company or other organization, you represent that you have authority to bind it, and "you" and "Customer" mean that organization. If you do not agree to these Terms, do not install the extension, subscribe, or use the Service. Your continued use of the Service after a change to these Terms takes effect (see Section 22) is acceptance of the change.
2 Eligibility #
You must be at least 18 years old and able to form a binding contract. The paid Service is sold for business use. The free local scan may be installed by an individual or an organization. CybrGate is not directed to children (see the Privacy Policy). You represent that your use complies with all laws that apply to you.
3 The Service #
CybrGate has two parts.
- The free local scan. The extension reads the installed-extension inventory from
chrome.managementon the device, scores it with the same engine the server runs, and shows the result in the extension. It needs no account and no server, and it transmits nothing. A page-side sentry also runs locally. - Paid continuous monitoring. Fleet rollup across enrolled browser profiles, signed policy push, an append-only audit log, package-level analysis of extension bundles, and declared-versus-observed destination monitoring.
CybrGate is not: a guarantee that every malicious extension or injection will be detected; antivirus, endpoint protection or data-loss prevention; a compliance certification; or a replacement for your own security program. A lower score is not a clean bill of health, and where a check did not run the Service says it was unassessed. Read the Disclaimers before relying on it.
4 Accounts, administrators & seats #
An organization has administrator users with roles (owner, admin, member, viewer). Owner and admin accounts must enroll a second factor (TOTP) before they can use privileged features. You are responsible for keeping credentials confidential, for all activity under your organization, and for the people you give roles to. Tell us promptly at hello@ardynamicsinc.com if you believe a credential is compromised.
A seat is one enrolled browser profile. Enrollment uses a single-use token issued by an administrator. If the number of active seats exceeds the number you purchased, the Service flags the organization as over its limit, and we may ask you to purchase the additional seats.
5 Subscription, price & auto-renewal #
Paid monitoring costs $8 to $12 per seat per month in US dollars, as shown to you on Stripe Checkout before you pay. The price depends on the two tiers: Team at $8 per seat per month covers continuous fleet monitoring — fleet rollup, signed policy push, the append-only audit log, and version-escalation detection; Business at $12 per seat per month adds package-level analysis of the extension bundle, declared-versus-observed destination monitoring, longer retention, and priority support. You buy by self-serve checkout; there is no sales call.
The subscription renews automatically every month until you cancel. Before you pay we show the recurring price, the interval and the fact that it renews until cancelled, and we ask you to tick an unchecked box to consent. Payment is processed by Stripe, and card data is never received by our servers. The free local scan costs nothing, and paying nothing means our aggregate liability is $0.00 (Section 16).
If we change the price, we will give you at least 30 days' notice before it applies to you, and you may cancel before the new price takes effect. Taxes, where they apply, are added by Stripe at checkout.
6 Cancellation #
You can cancel online, at any time, with no call, no email and no retention offer: [OWNER_CONFIRM: billing portal URL]. Cancelling is designed to be as easy as signing up. Cancellation takes effect at the end of the period you have already paid for, your access continues until then, and you are not charged again afterward. See the Refund & Cancellation Policy.
7 Refunds #
All fees are non-refundable. You cancel at any time and keep access through the period already paid for; we do not refund partial months, unused seats, or time remaining after cancellation. Full details are in the Refund & Cancellation Policy. The most we will ever refund or pay you for any claim of any kind is one month of fees (Section 16). This does not reduce any non-waivable statutory right.
8 Your responsibilities, including employee notice #
CybrGate runs on employees' browsers and reports on what is installed there. You, not AR Dynamics, decide to deploy it and to whom. You agree to:
- give your employees, contractors and other users every notice, and obtain every consent or works-council approval, that the law of the places they work requires before you enroll their browser profiles;
- choose the telemetry level (none, inventory or events) and retention period that you are lawfully entitled to choose, and tell your people what CybrGate reports (see the Privacy Policy for the exact fields);
- not use CybrGate to collect information it is not designed to collect, or to monitor people in a manner the law forbids;
- handle administrator access responsibly, because an inventory is a map of your internal tools and the AI assistants your staff use.
For personal data in your organization's fleet data, you are the controller and AR Dynamics is your processor under the Data Processing Agreement. By default an employee can see their own report in the extension, and an administrator can turn that off. CybrGate does not provide legal advice about monitoring employees.
9 Acceptable use #
You agree to use the Service lawfully and in line with the Acceptable Use Policy. We may suspend or terminate access for violations (Section 19).
10 Customer data & privacy #
"Customer Data" means the data your enrolled browsers and administrators send to the Service. You own it. You grant us a limited license to process it only to provide, secure and support the Service, and as the Data Processing Agreement describes. We do not sell Customer Data and we do not use it to train AI models.
Page content is scanned in the page and is never transmitted. The journal has a per-event field allow-list and drops anything undeclared. The free tier transmits nothing. The Privacy Policy is incorporated into these Terms and describes exactly what we collect, for how long, and why.
11 AI features #
CybrGate uses AI in one place. A local Gemini Nano classifier, reached through the Chrome Prompt API, runs on the user's own device as a second-stage false-positive filter. It is asked only about ambiguous content, and it can only lower a verdict, never raise one. Page content is never uploaded to run it. CybrGate does not itself trigger the download of the model.
- Outputs may be inaccurate. A local model can be wrong. Its output is not professional, legal, security or compliance advice, and you must not treat it as the only control standing between an agent and a sensitive action.
- The product works without it. Deterministic signatures are the primary engine and run whether or not a model is present.
- It is not a chatbot. Its only output is a label and a confidence score. CybrGate has no conversational assistant and does not generate text, images, audio or video for you.
- The model and the Prompt API are provided by Google as part of Chrome, under Google's terms and not ours.
See also Privacy Policy, AI and Disclaimers, AI.
12 Third-party software & services #
The Service depends on Google Chrome and its extension APIs, Chrome Browser Cloud Management (or another channel that writes managed policy), and Stripe for payments. Those are not ours, are not covered by these Terms, and are subject to their own terms. A change to Chrome can change what CybrGate can observe, and we are not responsible for third-party behavior.
13 Intellectual property, feedback & publicity #
The Service, our software and our branding are owned by AR Dynamics Inc or its licensors and protected by law. We grant you a limited, non-exclusive, non-transferable license to install and use the extension and Service for your internal business purposes, subject to these Terms. You may not copy, resell, or reverse engineer the Service except as the law permits. If you send feedback, we may use it without restriction or obligation to you. We will not use your name or logo to promote the Service without your written permission.
14 Confidentiality #
Each party will protect the other's non-public information with reasonable care and use it only to perform or receive the Service, except where disclosure is required by law. Customer Data is your confidential information.
15 Disclaimers #
The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that it will detect every malicious extension or prompt injection, or that any score is complete or correct. Full detail is in our disclaimers, which form part of these terms.
16 Limitation of liability #
To the maximum extent permitted by law, AR Dynamics Inc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from or related to your use of the Service. Our total aggregate liability for any and all claims relating to the Service is limited to one (1) month of fees — that is, the monthly fee for your seats, or, if you pay for a longer term, one month's pro-rata share of that fee (for an annual term, one-twelfth of the annual fee). This cap is one month of service value regardless of how many months or years you have paid in total, how you were billed, how large any single payment was, or how recently you paid; prepaying for a longer term does not raise it. If you paid nothing, including for the free local scan or during any free period, our aggregate liability is $0.00. This one month of fees is the most you can recover from us for any and all claims combined, and it is your sole and exclusive remedy.
The limitation applies regardless of the legal theory (contract, tort, negligence, statute, or otherwise), applies to all claims in the aggregate rather than per claim, applies even if we were advised of the possibility of such damages, and survives and applies even if a limited remedy is found to have failed of its essential purpose. Nothing in this section limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, willful misconduct, or death or personal injury.
17 Indemnity #
You agree to indemnify and hold AR Dynamics Inc harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your unlawful deployment of the Service to people whose browsers you enroll, or your illegal or unauthorized use of the Service. This does not extend to claims arising from our own violation of law or these Terms.
18 Sanctions & export control #
The Service is not offered to anyone in a location subject to comprehensive US sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk and Luhansk regions) or on the US Treasury OFAC Specially Designated Nationals list. Stripe independently screens payments. You are responsible for your own compliance with export and sanctions law.
19 Term, termination & suspension #
These Terms last while you use the Service. You may stop and cancel at any time (Section 6). We may suspend or terminate access for breach of these Terms or the Acceptable Use Policy, non-payment, legal compliance, or to protect the Service or other customers, and we aim to warn first except where the harm is severe or ongoing. After termination you may ask us to erase your organization's data (see the Privacy Policy, retention). Sections that by nature should survive do, including Sections 13, 15, 16, 17 and 20.
20 Dispute resolution & arbitration #
Informal resolution first
Before filing any claim, you agree to try to resolve the dispute informally by writing to hello@ardynamicsinc.com and describing the issue. We will try to resolve it within 30 days.
Binding individual arbitration
If informal resolution does not work, you and AR Dynamics Inc agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or, for an individual using the Service for personal purposes, its Consumer Arbitration Rules), seated in the State of Hawaii, rather than in court, except as set out below.
Small-claims carve-out
Either party may instead bring an individual claim in small-claims court if it qualifies.
Class action & jury waiver
Any proceeding will be conducted only on an individual basis and not as a class, collective, consolidated or representative action. You and we each waive any right to a jury trial. The arbitrator may not consolidate more than one person's claims.
Mass-arbitration batching
If 25 or more similar arbitration demands are filed by or with the same counsel around the same time, the AAA and the parties will use reasonable procedures to batch and resolve them in coordinated groups, consistent with the AAA's mass-arbitration procedures.
30-day opt-out
You may opt out of this arbitration and class-waiver section entirely by writing to hello@ardynamicsinc.com within 30 days of first agreeing to these Terms, stating that you opt out of arbitration. If you opt out, disputes are resolved in the courts described in Section 21.
Mandatory rights
Nothing in this section limits any right you have under mandatory law in your country of residence that cannot be waived by contract, including, where it applies, a right to bring a claim in your local courts. If you reside in a place where this section is unenforceable as to you, disputes will be resolved in the competent courts of your place of residence.
21 Governing law & venue #
These Terms are governed by the laws of the State of Hawaii, USA, without regard to conflict-of-laws principles, and the Federal Arbitration Act governs Section 20. Subject to that section, the state and federal courts located in the State of Hawaii have exclusive jurisdiction and venue, except where mandatory local law requires otherwise.
22 Changes to these Terms #
We may update these Terms. We will change the "Last updated" date above and, for material changes, give reasonable advance notice (for example on this page or by email to your organization's owner). Continued use after a change takes effect is acceptance of it. A change to price follows Section 5.
23 Severability #
If any provision is found unenforceable, the rest remain in full effect and the provision will be interpreted to best reflect its original intent.
24 Entire agreement #
These Terms, together with the Privacy Policy, Refund & Cancellation Policy, Acceptable Use Policy, Disclaimers, Copyright & DMCA Policy, Cookies & Tracking and Data Processing Agreement, are the entire agreement between you and AR Dynamics Inc about the Service and supersede prior agreements on the subject.
25 Assignment #
You may not assign or transfer these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets, or by operation of law.
26 Force majeure #
Neither party is liable for delay or failure caused by events beyond its reasonable control, including internet or power outages, acts of government, natural disasters, or failures of upstream providers (including browser vendors and payment processors).
